Terms and Conditions

These Terms and Conditions (“Terms”) apply to your use of www.teamresurgence.com (the “Site”) and your purchase of or participation in any products or services offered by Resurgence Clinical Education (“Resurgence Clinical Education,” “I,” “me,” “my”), including online courses and educational materials offered through the Site (“Courses”) and one-on-one online clinical mentorship purchased through the Thinkific platform (“Mentorship”). Together these are the “Services.” By using the Site, creating an account, or purchasing a Service, you (“you” or “Client”) agree to these Terms.

1. Who These Services Are For

The Services are intended for licensed physical therapists, physical therapist assistants, and students or trainees in physical therapy, with a focus on orthopedic and sports settings. You must be at least 18 years old to purchase.

2. Educational Purpose and Professional Disclaimer

  • All Services are educational and professional development offerings. Nothing on the Site or in any Course or Mentorship session is medical advice, patient care, or legal advice.

  • Content reflects my training, experience, and the evidence available at the time. Research and best practices change, and I do not guarantee that content is complete, current, or applicable to every patient or setting.

  • You are solely responsible for your clinical decisions, documentation, and patient outcomes, and for practicing within your scope of practice, licensure, employer policies, and applicable laws.

  • If you are not a licensed clinician, the content is for general education only and should not be used to diagnose or treat any condition.

  • Viewing content or participating in Mentorship does not create a clinician-patient relationship between me and you or any of your patients.

3. No Guarantee of Results

I make no guarantees about specific outcomes from any Service, including exam results, certifications, job offers, promotions, fellowship or residency admission, clinical outcomes, or business success.

4. Continuing Education Credit

Unless a Course page explicitly states that it is approved for continuing education credit by a named organization or state board, no CE credit is offered. It is your responsibility to confirm whether a Service qualifies under your licensing board’s requirements. Completion certificates, where offered, confirm participation only.

5. Patient Privacy

  • Do not share protected health information (PHI) or any information that could identify a patient, including in Mentorship sessions, emails, messages, or any community, discussion, or comment area on the Site or within a Course.

  • All cases discussed must be de-identified in accordance with HIPAA and other applicable privacy laws, and your employer’s policies.

  • You are responsible for ensuring you have authority to share any case material and that it is properly de-identified. Any patient images or videos shown in Courses are used with appropriate permission, and you may not copy or redistribute them.

6. Accounts and Access

  • Course accounts and access are created and managed through the Site (Squarespace). Mentorship purchases are made and managed through Thinkific. You are responsible for keeping your login information confidential and for activity under your accounts.

  • Accounts, Course access, and Mentorship sessions are personal and non-transferable. Sharing login credentials or allowing others to use your access is prohibited and may result in termination of access without refund.

  • Resurgence Clinical Education may suspend or terminate accounts that violate these Terms.

7. Fees and Payment

  • Current pricing is listed on the Site or the applicable Thinkific purchase page at the time of purchase. Prices may change, but changes will not affect the price of a purchase you have already completed.

  • Payment is due at the time of purchase.

  • Course payments are processed through the Site, and Mentorship payments are processed through Thinkific, in each case by third-party payment processors. Resurgence Clinical Education does not store your full payment card information.

  • You are responsible for any taxes, fees, or charges imposed by your bank or payment provider.

  • Promotional codes and discounts cannot be combined unless stated, have no cash value, and may be withdrawn at any time.

8. Course Terms

8.1 License. When you purchase a Course, Resurgence Clinical Education grants you a limited, personal, non-exclusive, non-transferable license to access and view the Course for your own professional education. You do not own the content.

8.2 Access period. Unless otherwise stated on the Course page, you will have lifetime access to the Course. “Lifetime” means the life of the Course, and Resurgence Clinical Education may retire or replace a Course with reasonable notice.

8.3 Updates. Content may be updated, revised, or removed at any time. Unless stated otherwise, updates are included for as long as you have access.

8.4 Live components. If a Course includes live sessions or Q&A, I will make reasonable efforts to hold them as scheduled, and may reschedule if needed. Recordings, if provided, are for registered participants only.

8.5 Restrictions. You may not copy, record, download (except where a download is expressly offered), screen-capture, share, resell, redistribute, publicly post, or create derivative works from Course content.

8.6 Squarespace platform. Courses are hosted and delivered through the Site, which is built on Squarespace, a third-party platform. Your use of the Site is also subject to Squarespace’s terms and policies where applicable. Resurgence Clinical Education does not control Squarespace and is not responsible for its availability, features, or policies. I may move Courses to a different platform with reasonable notice, and your access to purchased Courses will continue on the new platform.

9. Mentorship Terms

9.1 Description. Mentorship consists of one-on-one, virtual sessions that may cover clinical reasoning, examination and treatment planning, return-to-sport decision-making, case discussion, and professional development. Mentorship is offered as individually purchased sessions.

9.2 Not clinical supervision. Mentorship does not satisfy any clinical supervision, residency, fellowship, mentoring-hour, or credentialing requirement unless I have agreed to that in writing.

9.3 Thinkific platform. Mentorship is sold and managed through Thinkific, a third-party platform. By creating an account or purchasing Mentorship through Thinkific, you also agree to Thinkific’s own terms of use and privacy policy, which govern your use of that platform. Resurgence Clinical Education does not control Thinkific and is not responsible for its availability, features, or policies. I may move Mentorship purchases to a different platform with reasonable notice, and your purchased sessions will remain valid.

9.4 Scheduling. Sessions are scheduled through Calendly and last 60 minutes. You may cancel or reschedule with at least 24 hours’ notice at no charge, using the link in your Calendly confirmation email. Sessions canceled or rescheduled with less than 24 hours’ notice, and no-shows, are considered used and are not refunded or made up. If you are more than 15 minutes late, I may end the session at its scheduled time and the full fee still applies.

9.5 My cancellations. If I need to cancel or reschedule, I will give as much notice as possible and offer an alternate time. If we cannot find a suitable time, you will receive a refund for that session.

9.6 Transferability. Purchased sessions are not transferable.

9.7 Recording. Sessions will not be recorded by either party without prior written consent from both.

10. Refund Policy

Courses

  • Because Courses are digital products with immediate access, all sales are final.

Mentorship

  • Sessions are refundable if canceled at least 24 hours before the scheduled start time.

  • Sessions canceled with less than 24 hours’ notice, and no-shows, are not refundable.

General

  • Approved refunds are issued to the original payment method within 5 to 10 business days.

11. Confidentiality

Resurgence Clinical Education will keep the content of Mentorship sessions and the information you share about your practice and career confidential, and will not disclose it without your permission, except where required by law. You agree to keep confidential any non-public materials or information about other clients that I share with you.

12. Intellectual Property

All content on the Site and in the Services, including text, videos, handouts, templates, frameworks, graphics, logos, and Course materials, is owned by Resurgence Clinical Education or used with permission and is protected by copyright and other laws. You may not copy, distribute, resell, publish, or create derivative works from it without written permission. You may use materials for your own personal professional education and, where applicable, for educating your own patients with proper attribution, unless a specific item says otherwise.

13. Your Feedback and Testimonials

If you submit comments, reviews, or testimonials, you grant Resurgence Clinical Education a non-exclusive, royalty-free license to display them on the Site and in marketing materials. I will ask for your permission before using your full name or identifying details.

14. Acceptable Use

You agree not to use the Site or Services to break any law, harass or harm others, upload malicious code, interfere with the operation of the Site or any platform used to deliver the Services, attempt unauthorized access, or misrepresent your identity or credentials. Both parties agree to communicate respectfully and professionally. Resurgence Clinical Education may suspend or end Services, with a refund for any unused prepaid Mentorship session, if continuing is not appropriate, including for abusive conduct, nonpayment, or requests that conflict with ethical or legal standards.

15. Technology and Availability

  • You are responsible for a compatible device, a stable internet connection, and a private space for live sessions.

  • Uninterrupted or error-free access to the Site, Courses, or any platform used to deliver the Services is not guaranteed. Technical problems on your end do not extend or reschedule a session. If a technical failure on my end prevents a session, I will reschedule it at no charge.

  • The Site and Services rely on third-party platforms and tools, including Squarespace, Thinkific, and Calendly, and may link to other third-party sites. Resurgence Clinical Education is not responsible for their content, availability, or practices.

16. Privacy

Resurgence Clinical Education collects and uses personal information (such as your name, email, and payment details) as described in its separate Privacy Policy. Information you provide when purchasing Mentorship is also processed by Thinkific under Thinkific’s privacy policy, information you provide through the Site is processed through Squarespace, and payment information is handled by third-party processors. By using the Services, you consent to those practices.

17. Disclaimer of Warranties

The Site and Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

18. Limitation of Liability

To the fullest extent permitted by law, Resurgence Clinical Education is not liable for any indirect, incidental, special, or consequential damages arising from the Site or Services, including any clinical, professional, or business decisions you make. Total liability for any claim is limited to the amount you paid for the relevant Service in the three months before the claim.

19. Indemnification

You agree to indemnify and hold Resurgence Clinical Education harmless from claims, damages, and expenses arising from your clinical practice, your breach of these Terms, your misuse of the Services, or your sharing of identifiable patient information.

20. Changes to These Terms

These Terms may be updated from time to time. The version in effect at the time of your purchase applies. Material changes will be communicated by email or posted on this page, and the Effective Date above will be updated.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Camden County, New Jersey.

22. Entire Agreement and Severability

These Terms are the entire agreement between you and Resurgence Clinical Education regarding the Services. If any provision is found unenforceable, the remaining provisions stay in effect. Failure to enforce a provision is not a waiver of it.
